These Terms & Conditions ("Terms") govern your access to and use of the NiveshSetu website at niveshsetu.com ("Platform"), operated by NiveshSetu ("we", "our", or "us"), located at B2, Ground Floor, Vishramnagar, Gurukul Road, Ahmedabad - 380052, Gujarat, India. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Nature of Services

NiveshSetu operates as a Digital Service Provider (DSP) and authorized marketing partner under the DSA/DSP distribution model. We are a financial services facilitation platform that provides information about and facilitates access to credit cards, personal loans, home loans, business loans, mutual funds, insurance, and other financial products offered by banks, NBFCs, insurance companies, and asset management companies ("Partner Institutions"). We do not ourselves issue credit cards, sanction loans, underwrite insurance policies, or manage investment funds. We do not hold, nor are we required to hold, an NBFC license, banking license, or any financial institution registration under RBI, SEBI, or IRDAI, as we do not engage in lending, borrowing, underwriting, or investment management. Our business model is comparable to financial product marketplaces and aggregators that operate as lead generation and distribution platforms. All financial products and services are provided directly by the respective Partner Institutions, subject to their own terms, conditions, and eligibility criteria. NiveshSetu earns referral and marketing commissions from Partner Institutions for facilitating customer connections. We do not charge any fees to users.

2. User Eligibility

By using this Platform, you represent that you are at least 18 years of age, are a resident of India, and have the legal capacity to enter into binding agreements. If you are accessing the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Role as Marketing Partner

NiveshSetu acts as a marketing and distribution channel partner for Partner Institutions. We facilitate customer enquiries and forward leads to the appropriate Partner Institutions for processing. All approval decisions, product terms, eligibility criteria, and disbursement processes are determined solely by the respective Partner Institutions. NiveshSetu has no control over product terms, eligibility requirements, or approval outcomes. Our role ends at lead facilitation — we are not a party to any financial contract between you and any Partner Institution.

4. Information Accuracy

While we make every effort to ensure that the information displayed on our Platform regarding financial products (including features, fees, interest rates, eligibility criteria, and benefits) is accurate and up to date, such information is sourced from publicly available data and Partner Institutions. Product details may change without prior notice. We strongly recommend that you verify all details directly with the respective Partner Institution before making any financial decision or submitting any application.

5. User Responsibilities

You agree to: (a) provide accurate and complete information when submitting enquiry forms or contacting us; (b) not use the Platform for any unlawful purpose or in violation of any applicable laws; (c) not attempt to gain unauthorised access to any part of the Platform or its systems; and (d) not reproduce, distribute, or create derivative works from Platform content without our prior written consent.

6. Third-Party Links & Referrals

Our Platform may contain links to websites operated by Partner Institutions and other third parties. When you click on such links or "Apply Now" buttons, you will be redirected to the respective third-party website. NiveshSetu is not a party to any transaction between you and the Partner Institution. Your use of third-party websites is governed by their respective terms of service and privacy policies. We do not endorse, guarantee, or assume responsibility for any third-party content, products, or services.

7. Communication Consent

By submitting your contact information through our Platform and providing explicit consent, you agree to receive communications from NiveshSetu via RCS, SMS, WhatsApp, Email, phone calls, and other communication channels regarding financial product information, service updates, and promotional content. You may opt out at any time by contacting us at info@niveshsetu.com.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, icons, software, and the overall design and layout, is the property of NiveshSetu or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, display, or create derivative works from any content on the Platform without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NiveshSetu and its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) your use of or inability to use the Platform; (b) any action taken based on information provided on the Platform; (c) any unauthorised access to or alteration of your data; or (d) any third-party conduct or content on or through the Platform. Our total liability to you for any claim shall not exceed the amount paid by you, if any, for accessing the Platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless NiveshSetu, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of any third party.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
